Terms of Service

Agreement

By accessing or using any Kognisant product (the platform, CLI, APIs, or console), you agree to these terms. If you do not agree, do not use our services.

Service Description

Kognisant provides AI infrastructure including inference APIs (Model Garden), GPU compute, device sync, AI Receptionist, and a free CLI tool. The CLI operates independently of our cloud services. Cloud features require an account.

Account Requirements

  • You must be at least 16 years old to create an account
  • One account per person
  • You are responsible for your account security
  • You must provide accurate information

Acceptable Use

You agree not to:

  • Use our services for illegal activities
  • Attempt to circumvent usage limits or rate limiting
  • Interfere with other users or the service infrastructure
  • Reverse engineer, decompile, or extract our proprietary systems
  • Use our services to build a competing product
  • Store or transmit malware through our infrastructure
  • Resell access to our APIs without written permission

Billing

  • Usage-based services are charged from your account balance
  • You are responsible for maintaining sufficient balance for your usage
  • Prices may change with 30 days notice
  • No refunds for consumed compute, inference, or transfer credits
  • If we experience extended downtime (>72h), affected paid users receive pro-rated credit

Plan Limits

Certain products have plan-based limits on devices, syncs, bandwidth, and storage. Exceeding limits results in feature restriction, not data loss. You will be notified before any enforcement action.

Data Ownership

You own all your data. We act as a processor, not a controller, of your content. We cannot access encrypted sync data. We do not claim any rights to content processed through our APIs or stored on our infrastructure.

Intellectual Property

The Kognisant platform, brand, documentation, and proprietary software are owned by Kognisant LTD. The CLI tool is distributed under its own license terms. Your use of our services does not grant you any rights to our intellectual property.

Service Availability

We provide our services on a best-effort basis. The CLI works independently of our cloud services. If cloud services are unavailable, all local features continue to work normally. We do not guarantee uninterrupted service.

Termination

  • You can delete your account at any time (Console → Settings)
  • We may suspend accounts for abuse or violation of these terms
  • Account deletion removes all server-side data permanently
  • Local CLI data is never affected by account actions

Limitation of Liability

To the maximum extent permitted by law, Kognisant LTD is not liable for indirect, incidental, special, or consequential damages arising from your use of our services. Our total liability is limited to the amount you paid us in the 12 months preceding the claim.

Governing Law

These terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.

Changes

We may update these terms from time to time. Material changes will be communicated via email or notice on our website at least 30 days before taking effect. Continued use after changes constitutes acceptance.
